The Bureau of Reclamation proposes a review of the contract template for utilization of excess capacity in Federal facilities pursuant to the Warren Act of 1911 (36 Stat. 925), Section 14 of the Reclamation Project Act of August 4, 1939 (53 Stat. 1187) and Section 305 of the Reclamation States Emergency Drought Relief Act of 1991.
The contract would provide for utilization of excess capacity in Federal facilities for storage and/or conveyance of Non-Project Water for up to five years and for up to 100,000 acre-feet for each contract.
Prior to the execution of the contract, the appropriate level of environmental documentation will be prepared to meet any requirements of the National Environmental Policy Act and Endangered Species Act, as amended, including compliance with applicable Biological Opinion(s).
