At its meeting on November 19, 2025, the California Water Commission (Commission) will consider modifying its Water Storage Investment Program (WSIP) regulations using the emergency rulemaking process. The modification would allow the Commission to increase the amount of conditional funding committed to a project on a case-by-case basis, to account for inflation and increased public benefits.
Attached to this announcement are the Commission’s Notice of Proposed Emergency Rulemaking, which includes the Finding of Emergency, and the proposed regulation language.

Public comment can be made to the Commission until November 19, 2025, via the following methods:

Comments submitted to the Commission on or before November 19 will be considered by the Commission before considering approval of the proposed regulation modification.
Public Comment to the Office of Administrative Law
If the Commission votes to approve the proposed emergency regulation, then Commission staff will file the proposed emergency rulemaking action with the Office of Administrative Law (OAL) on or about December 1, 2025. As part of its rulemaking package, Commission staff will also send any written comments received to OAL. Once received, OAL will publish a notice of submission on its website, and the public comment period (available under OAL’s emergency regulation review process) opens. The public has 5 calendar days (from the date the notice is published on OAL’s website) to submit written comments on the Commission’s proposed emergency regulation to OAL.
OAL will only consider a public comment if, and only if, it meets the following four criteria:
- The comment is submitted to OAL in writing (i.e., no verbal comments);
- The comment is received during the open comment period (i.e., within 5 calendar days after OAL posts the notice on its website);
- The comment notes that it relates to an emergency topic and identifies this proposed emergency rulemaking action from the Commission; and
- OAL confirms the Commission received the comment.
