NOTICE: U.S. Supreme Court Decision in Sackett – Army Corps Approved Jurisdictional Determinations (AJDs) Paused

From the Army Corps of Engineers:

On May 25, 2023, the United States Supreme Court issued a decision in the case of Sackett v. Environmental Protection Agency.  The U.S Army Corps of Engineers Headquarters is working with the EPA, Army, and Department of Justice to determine the full scope and effect of the decision.  As it will have implications on the determination of waters covered under the Clean Water Act, Corps staff have directed to pause until further notice completing Approved Jurisdictional Determinations (AJDs).  The Corps will continue to complete Preliminary Jurisdictional Determinations and verifications of aquatic resource delineations as requested.

As we learn more about this important Supreme Court decision, I will do my best to share the information with you.
