NOTICE OF PREPARATION for Temporary Change Involving the Proposed Transfer from Water Right Holders in the Sacramento Valley to the San Luis & Delta-Mendota Water Authority

Notice is hereby given that on February 18, 2022, Pleasant Grove-Verona Mutual Water Company (PGV) filed with the State Water Resources Control Board (State Water Board), on behalf of its participating shareholders (joint petitioners), Joint Petitions for Temporary Change under Water Code section 1725, et seq.  The joint petitioners are E. D. Willey and Son, Inc.; River Ranch Partnership; Brett Scheidel; Nicoli G. Nicholas; Maria John Nicholas Kelly Ranch, LLC; Murphy Lake Farms; and William L. Spangler.  The joint petitions request the transfer of a combined total of up to 15,439.5 acre-feet (af) of water for use within a portion of the Central Valley Project service area.  However, PGV joint petitioners indicate that only up to 15,139.2 af will be transferred.  Water will be made available for transfer through groundwater substitution and crop idling/shifting.  Temporary changes approved pursuant to Water Code section 1725 may be effective for up to one year.  

Each transfer is proposed to occur from May through September.  A link to all petition submittals is available on the State Water Board’s website at: 2022 Notices.  

The 30-day comment period per Water Code section 1726(f) has been reduced to 15 days per the Governor’s Proclamation of a State of Emergency in the Klamath River, Sacramento-San Joaquin Delta, and Tulare Lake watershed Counties due to drought (Drought Proclamation) dated May 10, 2021.  This Drought Proclamation will help expedite processing of water transfers.  

Comments filed in response to this notice must be received by 4:30 p.m. on March 15, 2022.
