CAL WATER FIX HEARING: Ruling on procedural matters, updated hearing schedule

Sur-rebuttal to begin on September 26

From the California Water Fix Hearing Team at the State Water Board:

Service List and Interested Parties,

This email transmits the hearing officers’ ruling on two procedural matters, and provides notice that hearing team staff will be deleting existing files in parties’ WaterFix File Transfer Protocol (FTP) folders.

On September 11, 2018, Local Agencies of the North Delta et al. and Friends of Stone Lakes et al. (LAND et al.) submitted a request for reconsideration of the hearing officers’ September 10, 2018 ruling.  LAND et al. request that the deadline for written sur-rebuttal testimony and exhibits be extended and that the scope of sur-rebuttal include any topic that was addressed in Part 2 rebuttal.  Several parties submitted joinders to both requests. The deadline for submission and service of written sur-rebuttal testimony and exhibits is extended until noon on September 21, 2018, and presentation of sur-rebuttal testimony will begin at 9:30 AM on September 26, 2018Click here for revised hearing scheduleUnless the hearing officers approve changes, the order of presentation of sur-rebuttal will be in numerical order based on the parties’ group numbers. The remainder of LAND et al. and joining parties’ request for reconsideration, including the request to expand the scope of sur-rebuttal, is denied.

The hearing officers grant the Department of Interiors’ request to cancel the October 8, 2018 hearing date, which is a federal holiday.

Parties should please note that starting next week, hearing team staff will be deleting all existing files in parties’ WaterFix File Transfer Protocol (FTP) folders in anticipation of the upcoming submittal of sur-rebuttal testimony and exhibits.  All parties’ WaterFix FTP folders will once again be private so parties can upload their sur‐rebuttal exhibits and testimony.  Hearing team staff will notify the service list once the folders become private.
